Legal Rules for the World Gem Photo Contest
Objective: Gain followers to publicize the school. Advertising begins on 5/14 and will end on 5/31. Participants must upload their photo to their own Instagram account and the photo with the most likes will be the winner. World Gem Foundation, through its Instagram account https://www.instagram.com/ will carry out a contest called ‘World GemFoto’ in which all Instagram users of legal age from all over the world, who are followers, may participate by [World Gem Foundation] Promotion name [World Gem Foundation], gives as a prize [Rubies, Sapphires and Emeralds course]. In order to participate in the promotion, interested users must access the page [contest page].
After accessing the page, users must fill in the form with their data and accept the data protection policy. Participants must leave their details on the contest page, provide their email address and accept the contest conditions. The winners will be published on the page of the contest and on the official Instagram account of the World Gem Foundation and on their website.
Prize
The prize is the World Gem Foundation’s Rubies, Sapphires and Emeralds course valued at $ 105 USD.
The World Gem Foundation is the organizer of this contest and will contact the winners by the e-mail address they gave when they entered the contest between June 1st and June 8th, 2021 in order to inform them that they have won the prize and give them the instructions on how to redeem it.
Within (15) calendar days from the day following the communication from [Contest organizing company], each of the winners must respond by e-mail to [Contest organizing company], confirming their prize.
In the event that any of the winners do not reply within the indicated period to accept the prize, if they do not comply with all or some of the rules of this Contest, or do not want or cannot enjoy the prize, the winner will be disqualified.
The prize has no cash value and cannot be exchanged for any other prize.
Personal Data Protection
Participants authorize that their personal data provided be incorporated into a file whose responsibility is the World Gem Foundation, which will use it to manage this promotional Contest, to contact the winners, to deliver the prize and to send them subsequent communications from the World Gem Foundation. This data will be treated confidentially and in accordance with Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights is an organic law approved by the General Courts of Spain that aims to adapt the Law Spanish internal to the General Data Protection Regulation.
Participants guarantee and are responsible for the veracity, accuracy, validity and authenticity of their personal information.

The World Gem Foundation reserves the right to adopt whatever measures are appropriate to avoid any conduct that the World Gem Foundation suspects has as its purpose or effect any attempt to act in fraud of this promotion or in breach of its rules or to the detriment of other participants, whose first and immediate consequence will be the exclusion of the participant and the loss of all rights to the prize that they may have obtained.
Creating or having more than one Instagram profile is prohibited. The World Gem Foundation reserves the right to invalidate, expel, eliminate or not take into account in the calculation those profiles that it considers suspicious of any attempt at fraudulent participation, including, but not limited to, the attempt to register more than a Facebook user profile by a person, creation of false profiles or identity theft. Likewise, The World Gem Foundation reserves the right to bring any suspicion in this regard to the knowledge of the company responsible for the Facebook platform, so that it can adopt the corresponding measures. Likewise, the World Gem Foundation, reserves the right to take any legal action that may correspond to it.
The World Gem Foundation, reserves the right to delete and exclude from the contest / raffle any response sent by users when it deems it appropriate.
The World Gem Foundation, reserves the right to exclude entries that contain pornographic or explicitly sexual elements.
Limitation of Liability
The World Gem Foundation is not responsible for interruptions or failures on the Internet, on their web page (www.worldgemfoundation.com), the cable network, electronic communications networks, software or hardware failures or for possible errors in the introduction and / or the processing of responses, submissions or personal data. In case of problems or incidents of this type, the World Gem Foundation will do everything in its power to correct them as soon as possible, but cannot assume any responsibility in this regard.
The World Gem Foundation excludes any liability for damages of any kind that, despite the security measures adopted, could be due to the improper use of services and content by users, and in particular, although not exclusively, for damages that may be due to the impersonation of a third party by a user.
Other Rules of the Promotion
The simple participation in this contest implies the acceptance of these rules in their entirety and the interpretive criteria of the World Gem Foundation, regarding the resolution of any questions derived from this contest, so that the manifestation, in the sense of non-acceptance of the same, implies the exclusion of the participant and, as a consequence of the same, the World Gem Foundation, will be released from the fulfilment of any obligation contracted with him.
The World Gem Foundation, reserves the right to make changes to the rules or operation of this ‘Promotion’ at any time and / or terminate early if necessary for just cause, without any liability arising from this. However, these changes will be duly communicated through the contest page www.worldgemfoundation.com and, where appropriate, other means. The World Gem Foundation will do everything possible to prevent any change from damaging some participants with respect to others.
By participating in this promotion you acknowledge and accept that the intellectual property rights over the materials in this promotion correspond to the World Gem Foundation. The unauthorized reproduction, distribution or transformation of any advertising or promotional materials constitutes an infringement of intellectual property rights of the holder.
The following people will not be able to participate in this promotion:
The World Gem Foundation shareholders, directors and employees. People who are spouses, children, parents, and other people who live at the expense of the people indicated above. Any person who, in whatever capacity, has participated in the preparation of this promotion.
Interpretation of the Rules and Conflict Resolution
Spanish law will govern the interpretation and non-compliance of these ‘Terms and Conditions’. Any controversy that results from the interpretation or fulfilment of these rules will be submitted to the Courts and Tribunals of the city of Palma de Mallorca.
